Welcome to Kiss Me in Paris, where we turn Parisian dreams into reality! Please read these terms – they form the basis of our fantastic working relationship when you book our planning or photoshoot services.

🇫🇷 Our Agreement

These terms, along with your signed proposal or contract, form the agreement between you (“Client,” “You”) and Kiss Me in Paris SARL (“KMIP,” “We,” “Us”). The laws of France govern this agreement, and any disputes shall be resolved in the courts of Paris.

💍 Booking & Payments

  • Securing Your Date: Ready to make magic? To officially book our planning or photoshoot services and reserve your date, we require a signed contract/proposal and an initial deposit (typically 50% of the total fee, as specified in your proposal). This payment secures our dedicated availability for you and allows us to commence initial work and consultations.
  • Refundability: Please refer to the ‘Cancellations & Refunds’ section below for detailed terms regarding the refundability of payments, which differ between Planning Services and Photoshoots.
  • Final Payment: The remaining balance is due before or on the day of your photoshoot or event, according to the schedule outlined in your specific contract.
  • Payment Methods: Accepted payment methods (usually bank transfer or secure online payment) and details will be provided in your proposal/invoice. All prices are typically quoted in Euros (€).

❌ Cancellations & Refunds

We invest significant time and commitment from the moment you book. We understand plans can change, so please carefully review the specific cancellation policies applicable to the services you have booked:

Cancellation Policy for Planning Services

  • Strictly Non-Refundable: Due to the extensive nature of event planning, vendor coordination, securing venues, and making financial commitments on your behalf often months or even years in advance, all payments explicitly made for Planning Services (including the initial deposit/retainer and any subsequent installments) are strictly non-refundable from the moment they are paid.
  • This applies regardless of the reason for cancellation or how far in advance the cancellation occurs, as our dedicated work for your bespoke event commences immediately upon booking.

Cancellation Policy for Photoshoots

  • Cancellations made MORE than 10 full business days BEFORE your scheduled photoshoot date: You will receive a full refund of the total amount paid specifically for the photoshoot, minus a 10% administrative fee. (This fee is calculated based on the total original booking value of the photoshoot.)
  • Cancellations made 10 full business days or LESS BEFORE your scheduled photoshoot date: Payments explicitly made for the photoshoot are non-refundable at this point.

General Conditions (Applicable to All Services)

  • No-Shows & Last-Minute Issues: No refunds will be provided for no-shows or cancellations occurring within 10 full business days of the scheduled service date/event start time due to any circumstances including (but not limited to): weather issues 🌧️, flight delays/cancellations ✈️, strikes, pandemics, governmental restrictions, pregnancy, health issues, changes of mind, relationship changes, etc.
  • KMIP Cancellation (Force Majeure): In the extremely rare event that KMIP cannot perform agreed services due to unforeseen circumstances entirely beyond our reasonable control (declared Force Majeure events under French law, debilitating illness preventing service delivery), we will notify you immediately. Our liability will be limited to refunding payments made directly to KMIP for the specific service(s) we cannot render, as determined under applicable French law. We will try to assist you in finding alternative arrangements, though this cannot be guaranteed.
  • Rescheduling: While we always try to be flexible, rescheduling requests are subject to our availability and may incur additional fees. Rescheduling is not guaranteed and does not override the cancellation policy terms based on the original booked date.

📸 Deliverables & Image Use

  • What You Get: For photoshoots/events with photography/videography, we deliver high-resolution digital files (edited images, potentially key unedited footage if agreed) via a secure online gallery or transfer. No physical products (prints, albums) are included unless specified in your contract.
  • Usage Rights: You receive a license for personal use of your images/videos (sharing with friends/family, personal social media, printing for yourselves). Commercial use is not permitted without prior written consent.
  • Copyright: The photographer/videographer retains the copyright to the images/videos created.
  • KMIP Portfolio Use: We love showcasing our work! We may request your permission (via a separate clause in your contract or a model release) to use selected images/videos from your event/shoot on our website, social media, and promotional materials. We will only use them with your explicit written consent.

🤝 Our Role & Responsibilities

  • KMIP: We promise to provide the planning, coordination, or photography services outlined in your specific contract with professional skill and care.
  • Client: We rely on you for timely communication, providing accurate information, making necessary decisions/approvals promptly, and adhering to the payment schedule.
  • Third-Party Vendors: As planners, we coordinate with various independent vendors (venues, caterers, etc.). While we select and recommend reputable partners, we cannot be held liable for the specific performance, failures, or actions of these third-party companies. Our role is coordination and planning.

👨‍👩‍👧 Minors

We may photograph minors as part of family shoots or events, always requiring permission from a parent or legal guardian, who should ideally be present during the shoot.

🛡️ Liability Limits

Except where prohibited by French law, KMIP’s liability is limited. We are not responsible for circumstances beyond our reasonable control, including acts of nature, weather, strikes, transportation issues, or client personal circumstances (illness, missed flights, etc.). Our total liability related to the services provided will not exceed the total fees paid by you to KMIP for those specific services.
